Japan Travel SIM Unlimited合同条款

Article 1: Nature of Service

  • The nature of Japan Travel SIM Unlimited(hereinafter referred to as "This Service") is as stated on https://tr.iijmio.jp.
  • 2.The Company may change the nature of This Service.
  • 3.The provider area of This Service shall be the region set forth by the Company in Japan.

Article 2: Procedures for Usage

  • The user must complete procedures for commencing This Service using methods separately stipulated by the Company within thirty (30) days following the purchase of the SIM card needed to use This Service (hereinafter referred to as "SIM Card").

Article 3: Usable Term

  • The provider term for This Service shall be calculated from the day on which the user has established communication using the SIM Card, as determined by the plan selected by the user, and shall be ten (10) days for the 10-day plan, fifteen (15) days for the 15-day plan, and thirty-one (31) days for the 31-day plan.

Article 4: Limitations on the Transfer of Rights, Etc.

  • The user may not transfer rights or SIM Cards for receiving the provision of This Service.
  • 2.The user may not allow a third party to use This Service.

Article 5: ID and Password

  • The user shall assume responsibility for managing the telephone number and passcode information that accompany the SIM Card(hereinafter referred to as "ID, Etc."), and may not allow a third party to use them.
  • 2.Upon the exercise of the rights in these General Conditions by the user, the Company may ask the user to present their ID, Etc.
  • 3.The Company will not assume responsibility for damages to the user caused by the theft of the ID, Etc., the SIM Card or for damages afflicted on a third party by the user.

Article 6: Requirements of Service Usage

  • In using This Service, the following requirements shall be applied.
    • (1) The user may neither use This Service with a means of communication other than the SIM Card nor conduct communication over This Service through connecting with an dial-up access point other than one designated by the Company.
    • (2) The user shall adhere to the below matters with respect to the SIM Card. (i)The user shall not use the SIM Card in a manner outside of conventional usage, including disassembling or destroying it or reverse-engineering its software, with the exception of cases where it has the consent of the Company. (iv)The user shall not bring the SIM Card outside of Japan with the exception of cases where it has the consent of the Company. (v)The user shall manage the SIM Card with the due care of a prudent manager.
    • (3) In cases where the user has ceased to use the SIM Card, including but not limited to cases where usage of This Service has come to an end for any reason, the user shall return the SIM Card to the Company without delay.
    • (4) A substitute card will not be provided in cases where the user misplaces or destroys the SIM Card.
    • (5) The user may not use This Service with a device or equipment other than that designated by the Company or that which conforms to technological standards stipulated under the law.

Article 7: Terms of Communication

  • The Company shall post information regarding the coverage area for the Service on a website of its designation. However, even when you are within the coverage area, communication may not be possible in locations where radio waves do not travel well, such as indoors, underground, in tunnels, behind buildings, in mountainous areas, or at sea.
  • 2.The Company may relocate, reduce, etc. the number of wireless base station facilities without prior notice due to technical or other unavoidable reasons. In such cases, communication may no longer be possible even within the coverage area under the preceding paragraph.
  • 3.Communication related to the Service shall comply with the communication protocols separately stipulated by the Company or its partner mobile carriers. However, this does not constitute a guarantee of Internet speeds related to those communication protocols.
  • 4.Internet speeds for the Service are subject to fluctuation depending on communication conditions, the communication environment, and other factors.
  • 5.Users may not configure lines for two or more wireless devices simultaneously to conduct communication in a single Service subscription.
  • 6.Depending on radio wave conditions, etc., information, etc. transmitted or received using the Service may be corrupted or lost. In such cases, the Company shall bear no liability whatsoever.
  • 7.The IP address used for wireless devices shall be designated and dynamically assigned by a partner mobile carrier. The user may not use the Service with any IP address other than that one.

Article 8: Erasure and Disposal of Information on SIM Card

  • In the following cases, the Company may erase the user identification number and other information registered on SIM Card it has loaned out. The Company shall bear no liability for any damages resulting from the erasure of that information.
    • (1) When the service subscription relating to the loan of that SIM Card is terminated.
    • (2) When the SIM Card is no longer in use due to a change in the SIM Card or other reasons.

Article 9: Protection of Personal Information

  • The Company shall handle the personal information of the user (“Personal Information”) appropriately in accordance with laws, regulations, and IIJ’s separately stipulated Personal Information Protection Policy.
  • 2.The Company shall handle Personal Information obtained in connection with the provision of the Service within the scope of the following purposes of use.
    • (1) To conduct business relating to the provision of the Service. (Includes making contact, issuing notifications, etc., to the user that are required for business purposes.)
    • (2) To conduct questionnaire surveys and analyze the results thereof to help maintain and improve the level of the Service.
    • (3) To display information on IIJ products and services (Includes information on IIJ products and services other than the Service, information introducing new products and services by IIJ, etc.) or information on products and services by partners on the IIJ website accessed by the user or on other content on user devices, or to provide that information by sending it via email or regular mail, etc. or by telephone. The Company reserves the right to discontinue or resume the handling of the foregoing through methods separately stipulated by the Company.
    • (4) To conduct business incidental to the preceding items.
    • (5) To use Personal Information within any other scope of consent obtained from users.
  • 3.The Company may provide Personal Information to third parties to the extent necessary based on user consent. Additionally, in cases where it entrusts all or part of the handling of Personal Information relating to the provision of the Service to a third party, The Company shall do so under its supervision and responsibility.
  • 4.Notwithstanding the preceding paragraph, if the requirements for a demand pursuant to laws and regulations or a demand for disclosure pursuant to Article 5 of the Act on the Limitation of Liability for Damages of Specified Telecommunications Service Providers and the Right to Demand Disclosure of Identification Information of the Sender (Act No. 137 of 2001) are met, or in other cases prescribed by laws and regulations, the Company may disclose Personal Information to the demanding party within the scope of that demand.

Article 10: Limits on Usage Pertaining to Child Pornography

  • The Company may limit communication for the purpose of accessing or obtaining child pornography set forth under the Act on Punishment of Activities Relating to Child Prostitution and Child Pornography, and the Protection of Children.

Article 11: Wi-Fi

  • The user may use the “au Wi-Fi SPOT” service provided to the user by Wire and Wireless Co., Ltd. (hereinafter referred to as the “Wi-Fi Partner Operator”) pursuant to the Public Wireless LAN Service Contract Terms and Conditions. In connection with authentication for “au Wi-Fi SPOT,” if the Wi-Fi Partner Operator requests KDDI Corporation to confirm the validity of the SIM Card used by the relevant the user, the user hereby agrees in advance that KDDI Corporation may respond to such inquiry.
  • 2.The Company shall bear no liability whatsoever, regardless of the reason, for any damages arising in connection with the response under the preceding paragraph.

Article 12: JAPAN Roaming™ Feature

  • The JAPAN Roaming™ Feature refers to the service conditions for JAPAN Roaming™ published by KDDI Corporation on its website, and the user may use the JAPAN Roaming™ Feature in accordance with such service conditions.

Article 13: Halting of Usage

  • The Company may halt the provision of This Service in instances where its telecommunications equipment undergoes maintenance or encounters trouble or in other instances where unavoidable reasons are present. In such cases, the Company shall endeavor to disseminate the facts surrounding said halting through means such as making a posting on its website related to This Service.

Article 14: Suspension, Etc. of Usage

  • In instances where the user falls under any of the following occurrences, the Company may suspend all or part of the provision of This Service or limit usage of This Service. Please see the Company's website for specific examples of these occurrences.
    • (1) When the user is in violation of its obligations as set forth in these General Conditions
    • (2) When the user has used This Service illegally or in a manner that clearly runs contrary to public order and morality
    • (3) When the user has used This Service in a manner that seriously hinders the use of Company-provided services by persons who directly or indirectly use said services
    • (4) When the user has used This Service in a manner that risks tarnishing Company-provided services
    • (5) When the user has used This Service in a manner other than the foregoing that is judged by the Company to be inappropriate

Article 15: Cancellation of Agreement

  • In instances where the user falls under either of the following occurrences, the Company may cancel the agreement for This Service.
    • (1) When the user does not contact the Company despite thirty (30) days having elapsed since a suspension of usage, etc. according to Article 14 was conducted.
    • (2) When a suspension of usage, etc. according to Article 14 was conducted and the Company judges that the user-side reason pertaining to said suspension of usage, etc. has not been resolved

Article 16: Warranty and Limitation of Liability

  • The Company will not provide any warranty for the availability of communication, delay times or any other aspects of the quality of communication in connection with This Service.
  • 2.The Company will not be liable for the compensation of damages incurred by the user in connection with the usage of This Service (irrespective of the cause thereof). However, this shall not apply in cases where said damages have occurred as a result of the willful or gross negligence of the Company.
  • 3.In instance where the Company has compensated a third party for damages caused to it by the user in connection with the usage of This Service, the Company reserves the right to claim for the compensation of said damages by the user.

Article 17: Language

  • The "Japan Travel SIM Unlimited Agreement Terms and Conditions" worded in Japanese constitutes the formal written agreement between the Company and the user. Documents of the agreement worded in a language other than Japanese constitute translations for reference purposes, and do not have effect as formal written agreements.

Article 18: Governing Law and Agreed Court of Exclusive Jurisdiction

  • These General Conditions shall be interpreted in accordance with the laws and ordinances of Japan. Should the need for litigation arise between the Company and the user, said litigation shall be submitted to the exclusive jurisdiction of the Tokyo District Court in the first instance.

第1条（服务内容）

  • Japan Travel SIM Unlimited（以下简称「本服务」）内容依照 https://tr.iijmio.jp 所述。
  • 2.本公司有可能对本服务内容进行修改。
  • 3.本服务提供区域为本公司规定的日本国内地区。

第2条（使用手续）

  • 用户应在购买使用本服务所需的SIM卡（以下简称「SIM卡」）后30天内，依照本公司另行规定的方法登记本服务开始使用打算日（仅限于可以登记开始使用打算日的情况下），并完成使用本服务的手续。

第3条（可使用期间）

  • 本服务的提供期间，将根据用户所选择的方案，自使用SIM卡建立通信之日起算；其中，10日方案为10日，15日方案为15日，31日方案为31日。

第4条（权利等转让限制等）

  • 用户不得转让本服务提供的权利以及SIM卡。
  • 2.用户不得让第三人使用本服务。

第5条（ID及密码）

  • 用户应对SIM卡附带的电话号码、密码信息（以下简称「ID等」）负有管理责任，不得让第三人使用。
  • 2.用户在行使本条款规定的权利时，本公司有可能会请用户出示ID等。
  • 3.本公司对于ID等或SIM卡的失窃所造成的用户损失或者用户带给第三人的损失，概不负责。

第6条（使用服务的条件）

  • 使用本服务时需要满足以下条件。
    • (1)用户不得使用SIM卡之外的通信方式使用本服务，也不得连接本公司指定外的拨号连接对象使用通讯服务。
    • (2)用户在SIM卡方面应遵守以下事项。 (i)除非本公司允许，一律不得分解、损坏SIM卡以及不得进行软件的逆行仿制以及其他SIM卡一般用途之外的使用。 (iv)除非本公司允许，不得将SIM卡带出日本国外。 (v)保管人应尽管理责任，妥善保管SIM卡。
    • (3)因任何事由停止使用本服务，以及已经不使用SIM卡时，用户应立即将SIM卡归还本公司不得延迟。
    • (4)SIM卡丢失或损坏时，本公司不提供替代品。
    • (5)用户必须使用本公司规定的设备终端或符合法律规定技术标准的设备终端，否则不得使用本服务。

第7条（通信条件）

  • 本公司将在指定网站公布可使用本服务的区域。但是，即使在该区域内，室内、地下、隧道、楼宇遮挡处、山区、海上等信号难以覆盖的地方也可能无法通信。
  • 2.本公司有可能基于技术上或其他不得已的理由，在未事先通知的情况下迁移或减少无线基站设备。这种情况有可能导致即使处于前述区域内也无法继续通信。
  • 3.本服务涉及的通信应遵循本公司或合作手机运营商另行规定的通信协议。但是，不保证该通信协议下的传输速度。
  • 4.本服务涉及的传输速度会因通信情况、通信环境以及其他因素发生变动。
  • 5.在单件服务合约的情况下，用户不可同时为2台以上的无线设备设定通信线路进行通信。
  • 6.使用本服务传输的信息等有可能因电波状况等原因出现损坏或丢失。对此情况本公司不承担任何责任。
  • 7.无线设备所使用的IP地址由合作手机运营商指定并动态分配。用户不得利用该IP地址之外的IP地址使用本服务。

第8条（SIM卡的信息清除与销毁）

  • 在以下情况，本公司将清除所提供SIM卡中登记的用户识别码及其他信息，且本公司不承担因信息清除所导致的任何损害责任。
    • (1)提供该SIM卡所涉及的服务合约已解除。
    • (2)因SIM卡更换或其他原因不再使用该SIM卡。

第9条（个人信息保护）

  • 本公司将依据法律法规及另行制定的《个人信息保护政策》，对用户的个人信息（以下简称“个人信息”）进行妥善管理。
  • 2.对于因提供本服务而获取的个人信息，本公司将在以下使用目的范围内进行处理：
    • (1)执行提供本服务相关的业务。（包括针对用户的、业务上必要的联络及通知等。）
    • (2)为维持并提升本服务水平而开展的问卷调查及其分析。
    • (3)将本公司商品、服务相关信息（不仅限于本服务，还包括本公司的其他商品、服务或本公司的新商品、服务介绍信息等）或合作伙伴的商品、服务等信息，在用户访问的本公司Web网站及其他用户终端设备上显示，或通过电子邮件、邮寄等方式发送，或通过电话联络。此外，用户可通过本公司另行指定的方法中止或恢复上述处理。
    • (4)之前各项附带的相关业务。
    • (5)其他用户同意范围内的使用。
  • 3.本公司有可能在必要的程度内，基于用户同意将个人信息提供给第三方。另外，当把提供本服务的相关业务中涉及个人信息处理的全部或一部分委托给第三方时，该个人信息的委托将在本公司的监督责任下进行。
  • 4.尽管有前款规定，若有基于法律法规的要求，或者满足特定电气通信信息流通产生的权利侵害等的应对法律（2001年法律第137号）第5条规定的披露请求条件，或者有其他法律法规依据时，本公司将在相应要求范围内向提出要求者披露个人信息。

第10条（儿童色情相关的使用限制）

  • 基于对于儿童卖淫、儿童色情的相关行为等的处罚以及儿童保护等相关法律之规定，本公司有可能会对阅览儿童色情网站或取得相关产品的通信进行限制。

第11条（公共无线LAN服务的认证）

  • 用户可以使用Wire and Wireless Co., Ltd.（以下称「Wi-Fi提携事业者」。）依据公众无线LAN服务合同条款向用户提供的「au Wi-Fi SPOT」。在对「au Wi-Fi SPOT」进行认证时，若Wi-Fi提携事业者向KDDI株式会社请求确认用户正在使用的SIM卡的有效性，用户应事先同意KDDI株式会社对该照会予以答复。
  • 2.本公司对于因前项对应所生的损害，无论其理由如何，概不承担任何责任。

第12条（JAPAN漫游™）功能

  • 所谓JAPAN漫游™功能，是指KDDI株式会社在其Web网站公布的JAPAN漫游™之提供条件；用户得依据该提供条件使用JAPAN漫游™功能。

第13条（使用中止）

  • 在本公司电信设备进行维护、故障或其他不得已的情况下，本公司有可能会中止提供本服务。届时本公司将在本服务的相关网站刊登中止服务的事实，进行通知。

第14条（使用停止等）

  • 当用户有以下行为时，本公司可能会停止提供全部或部分本服务，或者进行使用限制。这些行为的具体事例可以参见本公司网站
    • (1)违反本条款规定的用户义务时
    • (2)在违法或者明显违反公共秩序道德的情形下使用本服务时
    • (3)对于直接或间接使用本公司服务的用户之使用权益，会产生重大影响的情形下使用本服务时
    • (4)有可能损害本公司提供的服务信誉的情形下使用本服务时
    • (5)上述各项之外，经本公司判断为不妥当的情形下使用本服务时

第15条（合同的解除）

  • 用户有以下行为时，本公司有可能解除本服务合同。
    • (1)基于前条规定的采取停止使用等处理后，经过30天用户也不与本公司联络时
    • (2)基于前条规定的采取停止使用等处理，并经本公司判断在停止使用方面，用户方的问题尚未解决时

第16条（保证与责任限定）

  • 关于本服务，本公司对通信的可用性、延迟时间及其他通信质量不提供任何保证。
  • 2.本公司对于用户使用本服务而蒙受的损害（不问其原因）不负赔偿责任。但该损失来自于本公司的故意行为或重大过失时，则不受此限制。
  • 3.用户因使用本服务对第三人造成损害，而本公司对该第三人进行了赔偿时，本公司可以对用户就该赔偿要求赔偿。

第17条（语言）

  • 以日文编写的《Japan Travel SIM Unlimited合同条款》为本公司与用户之间的正式合同文件。以日语之外的语言编写的文件仅为参考译文，不具有正式合同文件的效力。

第18条（准据法及专属协议管辖法院）

  • 本条款应以日本法进行解释，如果本公司和用户间需要进行诉讼时，应以东京地方裁判所作为本公司和用户间第一审的专属协议管辖法院。
